These Terms and Conditions set out the basis on which Rubbish Removal Bayswater provides waste and rubbish collection services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, company or organisation that books or uses our rubbish removal or waste collection services.

Services means any rubbish removal, waste collection, bulky item clearance, house or office clearance, or related service provided by us.

Waste means any items, materials or substances presented by the Customer for collection, removal or disposal as part of the Services.

We, us and our mean the operator of Rubbish Removal Bayswater.

Site means the address or location from which the Waste is to be collected or where the Services are to be performed.

2. Scope of Services

We provide rubbish removal and waste collection services to domestic and commercial Customers within our service area, including Bayswater and surrounding locations. The precise scope of Services for each job will be as agreed at the time of booking and confirmed in writing or by electronic communication where applicable.

Our Services may include collection of general household rubbish, garden waste, office waste, light construction debris, bulky items such as furniture and appliances, and other non-hazardous waste materials. Acceptance of any specific type of Waste is always subject to applicable waste regulations and our own operational and safety requirements.

3. Booking Process

3.1 Bookings can be made by telephone, email or through our online enquiry or booking system where available. All bookings are subject to availability and are not confirmed until we have acknowledged the booking and, where required, received any applicable deposit or pre-payment.

3.2 When making a booking, you must provide accurate information about the type and approximate volume or weight of Waste, access to the Site, any parking restrictions, and any other relevant details that may affect the provision of the Services.

3.3 We may request photographs of the Waste or Site, or ask additional questions, in order to provide an estimate and to assess whether we can lawfully and safely carry out the Services.

3.4 Any time or date for the provision of Services given at the time of booking is an estimate only. We will use reasonable endeavours to attend within agreed time windows, but we do not guarantee attendance at an exact time and will not be liable for any loss arising from delays, subject to clause 12.

4. Estimates and Pricing

4.1 Our prices may be based on factors such as volume, weight, type of Waste, labour time, access conditions, and disposal charges. Any price given before we attend the Site is an estimate only and may be revised after on-site assessment of the Waste and conditions.

4.2 Once on site, our team will assess the Waste and confirm the final price before starting the work. If you do not agree to the revised price, we will not be obliged to carry out the Services and may charge a call-out or cancellation fee as described in clause 7.

4.3 Unless otherwise stated, prices are inclusive of standard disposal fees for non-hazardous Waste. Additional charges may apply for difficult access, extra labour, waiting time, or for Waste that requires special handling or disposal.

5. Payments and Invoicing

5.1 Payment terms will be confirmed at the time of booking. Unless otherwise agreed in writing, payment is due in full on completion of the Services at the Site.

5.2 We accept various payment methods, which may include cash, debit card, credit card, or bank transfer, subject to availability and any conditions we specify. We reserve the right to refuse payment methods at our discretion.

5.3 For business Customers who have a credit account with us, invoices must be paid in accordance with the agreed credit terms. If no specific credit terms have been agreed, invoices must be paid within 14 days of the invoice date.

5.4 We reserve the right to charge interest on overdue sums at the statutory rate. We may also suspend further Services until full payment is received and may recover any reasonable costs incurred in pursuing overdue payments.

6. Customer Responsibilities

6.1 You are responsible for ensuring that access to the Site is safe, lawful, and suitable for our vehicles and staff. This includes arranging any necessary parking permissions, permits, or access codes before our arrival.

6.2 You must ensure that the Waste presented for collection is as described at the time of booking and that it does not include any prohibited, hazardous, or dangerous items unless we have expressly agreed in writing to accept such Waste in compliance with applicable waste regulations.

6.3 You must obtain any consents or permissions required from property owners, managing agents, neighbours or local authorities in order for us to carry out the Services at the Site. We will not be responsible for any failure to obtain such consents.

6.4 You agree to be present, or to ensure an authorised representative is present, at the Site at the agreed time to grant access, confirm the Waste to be removed, and make payment as required.

7. Cancellations, Amendments and Waiting Time

7.1 You may cancel or amend your booking by giving us reasonable notice prior to the scheduled attendance time. Our specific notice requirements and any applicable cancellation charges will be communicated at the time of booking.

7.2 If you cancel a booking at short notice or fail to provide access to the Site when our team attends, we may charge a cancellation or call-out fee to cover our reasonable costs, including travel and staff time.

7.3 If we arrive at the Site and are unable to perform the Services due to inaccurate information, unsafe conditions, or lack of required permissions or access, we may treat this as a cancellation by you and charge an appropriate fee.

7.4 If we are required to wait for more than a reasonable period of time to gain access, for Waste to be prepared, or for payment to be made, we reserve the right to charge waiting time at our standard rates or to leave the Site and treat the visit as a cancellation.

8. Waste Types, Prohibited Items and Regulations

8.1 We operate in accordance with applicable UK waste management and environmental regulations. We will not knowingly collect or transport Waste in breach of those regulations.

8.2 We do not accept certain hazardous or prohibited items unless expressly agreed and arranged in advance, which may include asbestos, clinical waste, chemicals, solvents, oils, pressurised containers, gas bottles, certain electrical items, and any Waste classified as hazardous under relevant legislation.

8.3 If hazardous or prohibited items are discovered within the Waste after collection, we may charge additional fees for safe handling, storage and lawful disposal, or return such items to you where legally permitted. You will be responsible for any fines, penalties or costs arising from your breach of waste regulations.

8.4 By presenting Waste for collection, you confirm that you are the owner of the Waste or have the owner’s authority to dispose of it, and that the Waste does not infringe the rights of any third party.

9. Performance of the Services

9.1 Our staff will carry out the Services with reasonable skill and care and in a manner consistent with good industry practice for rubbish removal and waste collection.

9.2 We will take reasonable steps to avoid damage to property while performing the Services, but you acknowledge that moving heavy items, accessing confined spaces, or working in restricted areas may carry an inherent risk of minor damage or disruption.

9.3 We reserve the right to refuse to carry out any part of the Services if, in our reasonable opinion, doing so would be unsafe, unlawful, or otherwise inappropriate. This may include situations where access is too restricted, items are excessively heavy or unstable, or the environment poses a health or safety risk.

10. Title and Risk in Waste

10.1 Once we have collected the Waste from the Site and payment has been or will be made in accordance with our terms, title to and risk in the Waste shall pass to us, subject to clause 8 regarding prohibited or hazardous items.

10.2 We will then be responsible for transporting and disposing of the Waste at licensed facilities or by other lawful means and in compliance with current waste regulations.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot legally be limited or excluded.

11.2 Subject to clause 11.1, we will not be liable for any loss of profits, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss arising out of or in connection with the Services or these Terms and Conditions.

11.3 Subject to clause 11.1, our total aggregate liability to you in respect of all losses arising under or in connection with the Services, whether in contract, tort, breach of statutory duty or otherwise, shall be limited to the total fees paid or payable by you for the specific Service giving rise to the claim.

11.4 You are responsible for removing or securing any items of value or fragile items from areas where we will be working. We will not be liable for damage to items that should reasonably have been removed or protected by you in advance.

12. Delays and Events Beyond Our Control

12.1 We will not be liable for any delay or failure to perform the Services where such delay or failure is caused by events beyond our reasonable control. These may include severe weather, traffic incidents, vehicle breakdowns, industrial action, accidents, or legal restrictions.

12.2 In such circumstances, we will use reasonable endeavours to notify you and to rearrange the booking for the earliest convenient time.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, rectify the issue.

13.2 We will handle complaints fairly and promptly and may request supporting information or evidence from you in order to assess your complaint.

13.3 If a dispute arises that cannot be resolved directly between us, either party may seek to resolve it through negotiation, mediation or, as a last resort, through the courts of England and Wales as set out in clause 15.

14. Changes to These Terms and Conditions

14.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time you make a booking will apply to that booking and the associated Services.

14.2 Where changes are material and may affect existing Customers, we will take reasonable steps to bring those changes to your attention.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Removal Bayswater.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found by any court or competent authority to be invalid, unlawful or unenforceable, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

16.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another organisation as part of our business operations, provided that this does not materially affect your rights.

16.4 These Terms and Conditions, together with any written confirmation or agreement relating to a specific booking, constitute the entire agreement between you and us in relation to the Services, and supersede any prior discussions, communications or representations.
